KIND Social Competition
These terms and conditions (the “Terms and Conditions”) govern your entry into and participation in the promotion. Please read these terms carefully before entering, as by entering, you are deemed to have accepted and agreed to be bound by these Terms and Conditions. Please retain a copy of these Terms and Conditions.
1. The Promoter: Mars Wrigley Confectionery UK Limited, 3D Dundee Road, Slough, Berkshire, SL1 4LG.
2. Eligibility: This competition is open to UK residents, aged 18 years or over at the date of entry, excluding employees of the Promoter and their immediate families, associated agents or anyone professionally connected with the competition.
3. Competition Period: The competition will run from 09:00:00 on 18.09.23 to 23:59:59 on 01.10.23 (the “Competition Period”). Entries must be submitted within this period in order to be valid.
4. Entry Instructions: To enter, nominate an individual you think deserves to be recognised for an incredible act (or acts) of kindness. Locate the KIND competition post on KIND’s social media accounts at Instagram.com/kindsnacksuk or facebook.com/KindSnacksUK/and post a comment describing their real-life act of kindness. Alternatively, submit your entry details at. www.kindsnacks.co.uk/mykindhero2023(open in new tab).
5. Entry Requirements: Entrant must consent and ensure that their nominee has consented to their act(s) of kindness being referenced in the entry and communicated publicly or to media by the Promoter for promotional purposes. The winning nominee will need to consent to accepting the main prize of a statue of themselves and be available for a body scan mould to be completed in the UK (at a location to be communicated at a later stage) on the w/c 9th October and available to travel within the UK on 12th - 13th November for the unveiling of the statue as well as appear in media interviews. No purchase is required to enter.
6. A maximum of three (3) entries per person is permitted, provided each entry nominates a different person for an act of kindness. All entries are limited to 2,200 characters only and must describe a genuine act(s) of kindness. Entries which simply tag a person and do not detail their act(s) of kindness will not be counted.
7. Selection Process: A shortlist of 20 entries will be selected from all valid entries by Ready10, on behalf of the promoter. A panel of judges will select the final winner. This panel will be formed of representatives from the Promoter and its agencies, Ready10 and Revolt and one independent judge. The shortlist will comprise of the 20 entries which best demonstrate and describe real acts of kindness, particularly those which have extended over a long period of time. The Promoter may contact the selected entrants by DM (or email or phone if the entrant submitted the entry online at www.kindsnacks.co.uk/mykindhero2023) to confirm that they and their nominated persons are willing to join the shortlist and be considered for the prize. You must make sure before responding to such request that you have confirmed with the nominated person that they consent to being added to the shortlist. If you or your nominated person are unwilling to join the shortlist, your entry will be removed from the selection process. From the shortlist, the panel of judges will then select one winning entry, demonstrating the greatest act of kindness. The individual submitting the entry and their nominated person demonstrating an act of kindness will both receive prizes (see Condition 11 below). The individual submitting the winning entry will be notified by no later than [05.10.23]
8. Shortlist, winner selection and any other decision of the Promoter regarding any aspect of the competition is final and binding. No correspondence will be entered into, except as expressly provided in these T&Cs.
9. Bulk entries, entries submitted by third parties, organised groups or those automatically generated by computer will not be accepted. Any person persistently trying to circumvent the entry process will be disqualified immediately.
10. To the fullest extent permitted by applicable law, the Promoter assumes no responsibility and is not liable for any person whose Instagram and/or Facebook account details are used to enter without their permission. The Instagram or Facebook account owner is accepted as the entrant and should they be selected as the prize winner, they will be the sole claimant of the prize, even if not responsible for posting the entry, or else the prize will go to the next selected winner.
11. The Prize: There is one first prize to be won, consisting of a prize for the entrant submitting details of the act of kindness, together with two prizes for the individual nominated for their act of kindness. The individual selected by the judges as submitting the entry best demonstrating a genuine act (or acts) of kindness by their nominated person, as well as the nominated person will each win a year’s supply of KIND bars (equating to 12 bars per month, 144 bars in total each). There is no substitute for this prize. The two winners (nominee and nominator) will receive a random selection of KIND bar varieties making up the prize. The prize will be delivered in 2 instalments. The awarding of the KIND bars prize to the person submitting the winning entry is conditional on the individual they nominated for their act of kindness agreeing to accept their prizes. In the event that the nominated individual declines the statue prize (see Condition 12 below), the Promoter will award the prize to the entrant submitting the next best entry selected by the judges (again, provided their nominated individual accepts the prize). This process of confirming the winner will continue until an individual nominated for their act of kindness accepts the statue prize.
12. The individual selected by the judges as demonstrating the greatest act of kindness will also win the commissioning of a statue of themselves. The statue will be life size. The statue will be presented to the winner at an unveiling to take place in the UK (location to be confirmed) on 12.11.23 or 13.11.23. As part of this prize, the winner will win a one-night stay in the UK where the unveiling is to occur for up to two people in a 4-star hotel, and return travel costs up to the value of £250. This will be booked by the Promoters representing agent Ready10 and is not transferable. Following the statue unveiling, the winner can discuss with the Promoter a location where the statue can be housed for a period of time. Prior to the statue being produced, the nominated individual will need to attend a session w/c 9th October at a location to be confirmed, to which travel for only the winner will be covered by the Promoter up to the value of £250, at which they will be measured and scanned for the production of an accurate statue replica of themselves. The winner may be required to sit or stand for up to two hours to complete the scan for the production of the statue. The winner will also be required to take part in reasonable promotional activity associated with their act of kindness and unveiling of their statue, including media interviews at the location of its unveiling and potentially in studio (all travel to interviews to be covered by the Promoter).
13. Prize Redemption: If you are selected as the winner having submitted the winning entry, the Promoter will DM you to notify you of the selection (or will call or email you using the details provided when registering if you have submitted the entry online at www.kindsnacks.co.uk). The winner will be required to provide address details for themselves and the individual they have nominated to which their KIND bars should be delivered, if their nominated individual accepts the prizes. The person submitting the winning entry and the nominee will receive their first instalment of their KIND bars prize within 30 days of confirmation that the nominee has agreed to accept the statue prize. The winner will be required to notify the individual selected as demonstrating the kindest act and making sure they have their permission to provide their contact and address details to the Promoter. Once approved and those contact details have been shared, the Promoter will contact the nominated winner to make arrangements for them to receive their statue prize. If the nominated individual declines to accept the statue prize, they will forfeit the right to all elements of the prize (including the trip and overnight stay). The individual who submitted the selected nomination will also forfeit their right to receive the KIND bars prize and the Promoter will then notify the entrant submitting the next best entry (in accordance with Condition 11 above).
14. The prizes are as stated, not for exchange or resale and no other prize alternatives are available. The Promoter will select an alternative winner, in the event that the individual nominated as demonstrating the kindest act decides not to accept their prize or reasonable promotion. Unless otherwise agreed in writing by the Promoter, the prize will only be awarded directly to the entrant (and their nominated person) responsible for the Instagram or Facebook account from which the winning entry was posted (or by phone or email address if submitted online). The Promoter reserves the right, at its sole discretion, to award an alternative prize of equal or greater value, should either of the advertised prizes (or any element of them) become unavailable for any reason.
15. General: The Promoter is not responsible for any entries which fail to be registered or are delayed for any technical or other reason whatsoever.
16. Use of Personal Data: Personal data provided will be used for the purposes of administering the promotion only. Please see Promotor’s Privacy Policy at https://www.mars.com/about/policies-and-practices/pp-english. The winners’ (both the individual submitting the entry and nominated person who has agreed to accept the statue prize) details will be retained for 30 days after the conclusion of the competition to allow the Promoter to arrange for delivery of the prizes and to deal with any queries from either winner. Either winner can request for their contact details to be deleted before the expiry of this period by writing to KIND Competition, Winner Details Deletion, c/o KIND EMEA Marketing team, Mars Wrigley Confectionery UK Limited, 3D Dundee Road, Slough, Berkshire, SL1 4LG , although the Promoter cannot be held responsible if such request means that it is unable to complete delivery of that winner's prize or assist them following deletion of their details.
17. The Promoter must either publish or make available information that indicates that a valid award took place. Except where either winner has requested that their details are not to be shared (noting that the Promoter may, notwithstanding any such objection, disclose required information to the Advertising Standards Authority if required to do so), the prize winners’ details (name and county of residence only) will be announced on Instagram and Facebook and at kindsnacks.co.uk and also made available for a period of 30 days if a member of the public sends a stamped addressed envelope to KIND Competition, KIND EMEA Marketing team, Mars Wrigley Confectionery UK Limited, 3D Dundee Road, Slough, Berkshire, SL1 4LG. A list of judges can be obtained from the same address by sending a stamped addressed envelope marked “KIND Competition Judges”.
18. The prize winners will be asked to take part in reasonable publicity in connection with the competition with no recompense for up to 90 days post the end of the competition. Such publicity will include promoting the unveiling of the statue and providing details on the amazing act of kindness demonstrated by the winner. In the event that the nominated individual indicates that they will not take part in such publicity, the Promoter reserves the right to award the prize to the next best entry selected by the judges.
19. The Promoter reserves the right to verify the winning entry including but not limited to asking for the winner's identity details and confirmation that the act of kindness actually took place (which they must provide within 14 days but which will not be retained following verification by the Promoter) and to refuse to award the prize or withdraw the prize entitlement and disqualify the participant where there are reasonable grounds to believe there has been a breach of these terms and conditions or any instructions forming part of the entry requirements or otherwise where a participant has gained unfair advantage in participating in the competition or won using fraudulent means.
20. The Promoter is not responsible in the event that either winner fails to receive their prize as a result of having provided inaccurate postal and/or email address or contact number details.
21. In the event of circumstances outside the reasonable control of the Promoter, or otherwise where fraud, abuse, and/or an error (human or computer) affects or could affect the proper operation of this competition or the awarding of the prize, the Promoter reserves the right to suspend the competition or amend these Terms and Conditions, at any stage, with no liability to any entrants or third parties, but will always endeavour to minimise the effect to participants in order to avoid undue disappointment.
22. A participant posting an entry on Instagram or Facebook accepts their terms and conditions. However, it is acknowledged that this competition is not sponsored or endorsed by, nor associated with, Instagram or Facebook. Entrants release Instagram and Facebook from any and all liability arising out of or in connection with their entry.
23. This competition and these Terms and Conditions shall be governed by and construed in accordance with English law and the parties to any dispute or action shall submit to the exclusive jurisdiction of the English courts. However, if you are resident in Scotland or Northern Ireland, you may bring your claim before the Scottish or Northern Irish courts (respectively), if you wish.
24. Entry into the competition shall constitute your acceptance of these terms and conditions and your agreement to be bound by them.
